If the Buyer orders and buys the goods offered in the Online Store, it is considered that the Buyer has read and unreservedly agrees with the general terms and conditions as well as the terms of the distance contract and undertakes to comply with them. In case of any violation of the Terms or regulatory enactments, Smart Pay SIA has the right to immediately withdraw from the agreement on the purchase made by the buyer and / or deny the buyer the use of the Online Store.

Distance contract

A distance agreement (hereinafter - the Agreement) is concluded between the Seller and the Buyer, who places an order and makes a purchase in the online store. The Agreement enters into force at the moment when the Buyer has placed the order using means of distance communication and has received confirmation from the Seller about the order placed by e-mail or telephone. The contract is valid until its execution, ie until the delivery of the ordered goods. The agreement applies to all orders and purchases made in the online store.

Delivery and payment procedure

The buyer orders goods through this website, indicating the type and quantity of goods to be ordered. The Buyer has the opportunity to pay for the product using the payment tools built into the Online Store or by paying the invoice prepared by the Seller and sent to the Buyer by e-mail in accordance with the order. The invoice is prepared electronically and is valid without a signature.

The Seller ensures the delivery of the goods within 1-2 working days from the receipt of payment for the goods, if the goods are in the seller's warehouse, coordinating the delivery time with the Buyer. If the product is not in the Seller's warehouse or we will not be able to ensure delivery within the specified time, the delivery time will be agreed with the Buyer separately.

Right of withdrawal

The Buyer has the right to withdraw from the Product within 14 calendar days from the moment of receipt of the Product by sending the Seller a letter of withdrawal. The Seller shall send the withdrawal letter form to the Buyer by e-mail upon the Buyer's request.

The Buyer is obliged to return the goods to the Seller within 7 days after sending the letter of withdrawal. All expenses that will be incurred in connection with returning the goods to the Seller shall be borne by the Buyer.

The buyer cannot exercise the right of withdrawal if:

• the ordered goods cannot be returned according to their nature,

• the buyer has opened the packaging of the audio or video recording or computer program.

Also, in order for the product to be returned, please note that the product should be:

• in the original packaging

• without damage and tears

• without signs of use

Section 12, Paragraph six of the Consumer Rights Protection Law of the Republic of Latvia stipulates that "the consumer is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal". The Seller reserves the right to refuse the Buyer to exercise the right of withdrawal or withhold compensation in case of damage to the product, negligent handling of the product during use or failure to follow the instructions, loss of the original packaging or significant damage to its packaging.

In order to exchange the product or return the money, we will ask you to comply with the above conditions. Adherence to them is a guarantee of harmonious cooperation and mutual respect!

Data processing

By entering the necessary information when placing an order, the Buyer confirms that he has read and agrees that the data provided by him is used so that the Seller can accept the Buyer's order and deliver goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering the information, the Buyer agrees that notifications related to the processing of the Buyer's order will be sent to the specified e-mail.

Privacy

We are responsible for ensuring that your personal information (name, surname, delivery address, etc.) will not be passed on to third parties unless required to do so by law enforcement.

The seller may request the following personal data for order processing, accounting purposes and product delivery arrangements: name, surname, address, telephone number and e-mail. The Seller's accounting is provided by an accounting company that has access to your data and is used only to ensure legally correct accounting for the Seller.

The data provided by the Buyer is stored on the website developer's platform, the Seller's computer and the e-mail address info@smartpay.lv. The data is protected and can only be accessed with a secure password. The storage period of the buyer's data is 5 years. The buyer has the right to access his data, request the deletion of data, correct his data, request the termination of data processing, the right to object to the processing of data, the right to withdraw consent.
